White House reviews RFS volumes rules

The White House Office of Management and Budget (OMB) is formally reviewing EPA’s final rules setting biofuel blending volumes under the renewable fuel standard (RFS) for 2021 and 2022, along with a retroactive cut in volumes for 2020, as the agency seeks to meet a June 3 consent decree deadline to issue the overdue measures. EPA sent the rules for prepublication review April 29, according to OMB’s website. OMB review typically takes up to 90 days, but here EPA has only one month to issue the final regulations, so OMB will need to shorten its review in order for EPA to meet its legal obligations. The 2021 rule was due to be finalized by statute Nov. 30, 2020, while the 2022 rule was due a year later, on Nov. 30, 2021, indicating just how far behind schedule EPA is with RFS implementation.
