A Justice Department official confirmed that the administration has not asked the Supreme Court to review a 10th Circuit Court of Appeals decision that voided three refinery exemptions from the Renewable Fuel Standard. ¬† In doing so, the administration signals it stands with farmers when it comes to the legality of the 10th Circuit’s January opinion. However, the agency still faces decisions on dozens of petitions for exemptions dating back to 2012.

In response, a spokesperson for American Fuel & Petrochemical Manufacturers¬†called the news “certainly disappointing,” but said a petition filed by its members can stand on its own merit. “We support the petition filed by our members last Friday and the ability for small refineries to seek relief ‘at any time’ when they face disproportionate economic harm because of growing RFS compliance burdens,” the spokesperson said.
