Refiners ask GAO to expand SRE review to include USDA role in waiver process

The U.S. Government Accountability Office’s (GAO) ongoing review of decisions EPA made on small refinery exemptions (SREs) under the Renewable Fuel Standard (RFS) should be expanded to include any efforts USDA may have made to influence the process, a group of small refiners said in a Wednesday letter to the government watchdog. In a letter to GAO Comptroller Gene Dodaro, Perkins Coie attorney LeAnn Johnson Koch, who represents the Small Refineries Coalition (SRC), said that while the Clean Air Act (CAA) only gives EPA and the U.S. Department of Energy (DOE) roles in SRE decisions, the Agriculture department may have “exerted improper influence” over the waiver process.
