Court Strikes Down Three RFS Waivers

A federal court ruled EPA didn’t have the authority to issue small-refinery exemption extensions to three companies that were not granted waivers originally. The ruling could affect how the agency implements the program. In a ruling handed down by the U.S. Court of Appeals for the 10th Circuit in Denver on Friday, the court also found EPA “abused its discretion” by not explaining its conclusion that a small refinery could suffer disproportionate economic hardship while also maintaining refiners passed on RFS compliance costs to consumers at the pump.  Even before Friday’s ruling, the Trump administration’s handling of the RFS was providing fodder for Democrats campaigning in Iowa, Eric reports this morning. Nearly all the Democratic candidates have been vocal in their support for ethanol as they’ve blasted the Trump administration’s use of the small refinery exemptions. Three Democratic candidates — Sen. Amy Klobuchar of Minnesota, former South Bend, Ind., Mayor Pete Buttigieg and billionaire investor Tom Steyer — have used national air time during debates to criticize the Trump EPA’s use of those waivers. Tenth Circuit Court Strikes Down EPA Small Refinery Exemptions

 In a decision that is expected to broadly impact the Environmental Protection Agency’s (EPA) approach to granting small refinery exemptions (SREs) under the Renewable Fuel Standard, the U.S. Court of Appeals for the Tenth Circuit late on Friday struck down three exemptions that were improperly issued by EPA. The court ruling stems from a May 2018 challenge brought against EPA by the Renewable Fuels Association 9RFA), the National Corn Growers Association (NCGA), the American Coalition for Ethanol (ACE), and National Farmers Union (NFU). Oil Falls to Three-Month Low as Virus Spread Raises Demand Fear

Oil tumbled to the lowest in more than three months as China’s deadly coronavirus crippled the world’s second-largest economy and threatened worldwide energy demand. Futures pared losses on Monday in New York after earlier dropping close to $52a barrel. Traders spooked by the worsening viral outbreak took some comfort from the Saudi Arabian assurances that the world’s biggest crude exporter is closely monitoring the situation and its impact on oil markets. The Better Fuel Initiative has the goal of increasing awareness around biofuels in Minnesota and to increase the present biofuel standard which is 10 percent to 15 percent biofuel!
