GOP states, industries sue EPA to block waivers for California truck rules

Republican-led states and several industry groups are suing to overturn EPA’s recent Clean Air Act (CAA) preemption waivers allowing California to implement its stringent heavy-duty truck zero-emission and warranty rules, with the critics expected to argue in part that the state failed to show it has “compelling and extraordinary conditions” warranting the waivers. “The EPA and California have no right or legal justification to force truckers to follow their radical climate agenda,” said Iowa Attorney General (AG) Brenna Bird (R) in a June 6 press release announcing a petition for review her office filed June 5 with the U.S. Court of Appeals for the District of Columbia Circuit that includes 18 other states with GOP AGs.
