EPA to provide GAO more information on small refinery waiver applications

EPA will provide the U.S. Government Accountability Office (GAO) with confidential business information (CBI) small refineries seeking exemptions from their Renewable Fuel Standard (RFS) compliance obligations have submitted or may submit between May 21, 2021 and Dec. 31, 2023, the agency said in a notice scheduled to be published in Thursday’s Federal Register. EPA in May 2021 handed over to the government watchdog information related to all SRE petitions since the start of the RFS program. In the new notice, EPA said GAO has requested SRE records submitted to the agency since the last request was fulfilled and extend to any SRE petitions submitted through the end of next year. The information request will include any new petitions submitted through the end of next year, as well as any supplemental information provided by refiners to their outstanding petitions for prior-year compliance, the agency said.
