EPA aims to propose post-2022 RFS blending volumes by December

EPA is aiming to issue by December a proposed rule that would set post-2022 Renewable Fuel Standard (RFS) blending targets, the Biden administration said in its spring unified regulatory agenda released Friday. Annual blending volumes set by Congress in 2007 expire after next year, and the Environmental Protection Agency will have greater authority to determine the Renewable Fuel Standard (RFS) program’s annual Renewable Volume Obligation (RVO). According to the notice, EPA would issue a notice of proposed rule-making in December and a final rule in December 2022. OMB also said in the document that EPA expects to issue a proposed annual RVO by July and final rule before December. EPA under the Trump administration failed to propose or issue a final RVO for 2021, and it is expected that the agency will combine blending targets for this year and next in a single rule.
